Data Notice

1. Introduction

This notice outlines the key information regarding the data generated by the use of Polestar products (such as our vehicles) and our related services (such as the Polestar App) by individuals and companies, such as existing and potential customers, lessees and fleet owners (‘you‘ or ‘user’).

This notice applies whenever you wish to exercise any of your rights granted by the EU Data Act with regard to the data generated as a result of your use of Polestar products and related services.

This notice does not apply to:

  • Your use of the Google Automotive Services: Polestar cars come with Google built-in, meaning that the infotainment system runs on the Android Automotive operating system offering Google Automotive Services (e.g., Google Maps, Google Assistant and Google Play Store). The infotainment system also offers the possibility to log-in with a Google account. In these instances, Google is responsible for your data and Polestar is not involved in the handling of your data. Your use of the Google Automotive Services is further governed by the Google Terms of Service and Google Maps Terms of Service.

  • Your use of third-party applications and services in the car: the features available in the app stores (e.g. Google Play Store, App Store) are offered by independent vendors, similarly with how they operate on a smartphone. When you connect your vehicle with a third-party application, your data and the data related to your vehicle is transferred to the third-party providing the application to enable the connection and your use of the third-party service.

  • Your use of third-party value-added services based on vehicle data (such as pay-as-you-drive insurance).

2. Who we are

Polestar Performance AB, hereinafter referred to as “Polestar”, “we” and “our”, will as data holder handle your data as described below.

3. What data we use

3.1 Overview

Our vehicles can generate various types of data, including performance metrics, usage statistics, and diagnostic information. The format in which data can be extracted is specified in the Section 3.2. below

The volume of data produced can range from a few megabytes to several gigabytes per day and is highly dependent on individual vehicle parameters (such as version, equipment, type of use, modifications, and digital service bookings). Data is generated in vehicles at different frequencies, and where required, also persisted locally within the vehicle. Depending on the purpose of collection, legal basis, your consent settings and the sensitivity of the data, data may also be collected and stored in the cloud periodically, or on specific events. Each vehicle has a unique alphanumeric 'Vehicle Identification Number' (VIN), which means most data generated from using a Polestar car and related services is considered personal data and is treated accordingly with the applicable data protection laws. 1.3 Types of data

Below you can find a list of data which connected Polestar products are capable of generating.The availability of data depends on the model of your car, the services with which your car is equipped, and on the services which you choose to activate. This notice describes the widest extent of data available. If you have an older car model, or if a new model is not equipped with a certain feature, the data associated with that feature will not be available.

4. How long we keep your data

We will only retain the data for as long as it is required for the purpose for which it is collected, or where we are otherwise legally obligated to keep the data.

The standard retention periods apply to personal data, which are referenced in our privacy documents available here. Where we no longer have a legitimate business need for the data, we will either anonymise it so that it is no longer capable of being associated specifically to you, or your vehicle, or we will delete it.

5. Your rights

You have specific legal rights granted by the EU Data Act relating to the data generated as a result of your use of Polestar products and related services. 

You have the right to access and retrieve and where relevant erease the data generated by your use of our connected products and our related services, as well as to allow you to share such data. 

You can manage your rights to your data by logging in with your login credentials into our Data Portal here. In addition, any third party of your choice can access data specified by you. If you want to stop sharing your data with any such third party, you can revoke the sharing through the Data Portal.

Please note, these rights are not absolute, and there are limits to what data you can access. For example, there are limitations in regard to data containing trade secrets, aggregated data, and highly enriched data. Should any exceptions or limitations apply to a request you make to us, we will always explain why we cannot fully or partly fulfil your request.

You also have a right to submit a complaint to your local authority should you have concerns about how we fulfill our legal obligations. However, we would appreciate it if you reached out and raised your concerns directly with us first to allow us to try to resolve them together. You can find our contact information in the section 6 below.

7. Changes to our Notice

We reserve the right, at our discretion, to modify our data practices and update and make changes to this data notice at any time. We continuously develop our products and services and will review and update this notice as a result. For this reason, we encourage you to revisit this notice regularly. The date at the top of this notice lets you know when it was last updated.
