Privacy Notice – Test vehicles

1. Intro

This document describes how Polestar processes your personal data in connection with the use of test vehicles on test tracks and public roads. Polestar makes use of the test vehicles for the purposes of development, testing and certification of cars and its functions, including the assisted, connected, partly automated and autonomous driving functions. For these purposes, we use our appropriately marked test vehicles to record data from various sensors, including video recording of the vehicle environment and audio recordings of the vehicle interior.

2. When do we process your personal data?

Use of test vehicles on test tracks and public roads

PurposeData collection is necessary for the purposes of development, testing and certification of cars and its functions, including the assisted, connected, partly automated and autonomous driving functions to ensure that Polestar vehicles meet applicable quality and road safety standards.
Categories of personal data

Test vehicles are equipped with various sensors (such as radar, ultrasonic sensor, GPS/localisation), microphones and video cameras. The surroundings of the test vehicles can be recorded on video and audio files and stored for later analysis, and combined with the further sensor data. The recordings of individual road users, license plates or other personal data may be contained in these video and audio recordings.

Please note, we are not interested in determining your identity and the system is not configured for that purpose, as this is not necessary for the development, testing and certification of cars and its functions, including the assisted, connected, partly automated and autonomous driving features. All traffic objects are therefore only categorized as cars, motorcycles, pedestrians, etc. The images are not used to identify the passing pedestrians, the different car models or their drivers.

Our legitimate interests (GDPR, article 6.1 (f)) in the development, testing and certification of cars and its functions, including the assisted, connected, partly automated and autonomous driving functions to ensure that Polestar vehicles meet applicable quality and road safety standards.

RetentionThe data collected within the context of the use of the test vehicle is stored for as long as it is necessary for development, testing and certification purposes and in connection with quality assurance measures, including long-term monitoring and development purposes.

3. How we disclose your personal data and who we disclose it to

In order to develop and validate safe and reliable algorithms for the development of cars and its functions, including the assisted, connected, partly automated and autonomous driving functions, we need to analyse a large volume of camera, audio and sensor data. To ensure reliability and accuracy of the results, we share your data with our cooperation partners.

Our cooperation partners include:

  • OEM partners, in order to cooperate in the field of research and development;

  • suppliers including development service providers and technology service providers.

The transfer of video, audio and sensor data to our cooperation partners is subject to contractual safeguards and can only be used strictly for the purposes specified by Polestar (i.e. for development purposes in the field of partially and fully automated driving).

To comply with applicable quality and safety laws and regulations, we also share your data with certification bodies and authorities.

4. Transfer of your personal data

We strive to process your personal data within the EU/EEA area. However, if data is processed in countries outside the EU/EEA, we ensure that the same high level of protection applies to your personal data in accordance with European data protection standards.

The European Union institutions have already established an adequate level of data protection for certain countries outside the EU, such as the United Kingdom, Canada, South Korea and Switzerland. Since the level of data protection is comparable, data transmission to these countries does not require special approval or any further safeguard being necessary.

5. Your rights

You have specific legal rights granted by the General Data Protection Regulation relating to the personal data we process about you. You can withdraw your consent or object to our processing of your data, access the data we hold about you, ask for rectification or restriction of your data, request to have your data ported to another entity, request that we delete your data, and finally you can file a complaint with a data protection supervisory authority. In Sweden, you have the right to lodge a complaint with the Swedish Supervisory Authority for Privacy Protection (IMY). A list of European supervisory authorities is available here.
